The Zyban® Promise Contest

Official Rules & Regulations

This Contest is sponsored by Biovail Pharmaceuticals Canada, a division of Biovail Corporation (the “Contest Sponsor”). The Contest starts Tuesday, January 2, 2008 at or about 12:00:01 a.m. ET and ends Friday, November 28, 2008 at 11:59:59 p.m. ET (the “Contest Closing Date”). There will be four (4) random draws, one (1) to be held on March 14, 2008 for all eligible entries received up to and including February 29, 2008; one (1) to be held on June 14, 2008 for all eligible entries received up to and including May 30, 2008, one (1) to be held September 14, 2008 for all eligible entries received up to and including August 29, 2008 and one (1) to be held December 14, 2008 for all eligible entries received up to and including November 28, 2008.

ELIGIBILITY

Contest is open to all legal residents of Canada, excluding Quebec, who have reached the age of majority in their province or territory of residence, except employees, representatives, agents, shareholders, officers and directors (and persons with whom they are domiciled) of the Contest Sponsor, its affiliated companies, advertising and promotional agencies and Marco Sales & Incentives Limited (“the Independent Contest Judging Organization”).

TO ENTER

  1. Visit the Contest web site at www.zybannet.com starting on or about 12:00:01 am ET,
    January 2, 2008 and print the Contest entry form to participate in The Zyban® Promise Contest. To participate you will be required to complete the entry form and mail your entry to The Zyban® Promise Contest, P.O. Box 4085, Paris, ON N3L 3W9 or fax to 1-888-281-9997.
  2. NO PURCHASE ENTRY. You may also enter by submitting a 150 word or more essay on “The Benefits of Quitting Smoking”. Include your name, complete address, birth date and daytime and evening phone number where you may be reached. Mail your entry to: The Zyban® Promise Contest, PO Box 4085, Paris ON N3L 3W9 or fax to 1-888-281-9997. Each submission must be an original work and must be handwritten, not mechanically reproduced and must be sent in a separate envelope bearing sufficient postage.

In order to be declared a winner, selected entrants that enter by completing and submitting an entry form obtained from the Contest website will also be required to submit (i) two (2) original DIN codes found on Zyban® packaging, and (ii) two signatures on Quitter Status Form (one from your prescribing physician and one from a friend or family member) which will be forwarded to the selected entrant for completion in order to meet eligibility requirements and to confirm your QUITTER status.

Entries that are incomplete, lost, stolen, late, delayed, misdirected, illegible, damaged, altered, irregular, destroyed, have been submitted through illicit means, or do not conform to or satisfy any condition of these Official Rules shall be disqualified.

Limit of one entry per person or household per draw period as defined above regardless of method of entry. In the event it is discovered that you attempted to enter more than once per draw period, then all of your entries will be void.

PRIZES

There will be a total of four (4) prizes available to be won. Each Prize will consist of $1,000.00 in cash to the winner and a $1,000.00 donation (in the Contest Sponsor’s name)  to a Cancer Research Center to be recommended by the selected entrant and approved by the Contest Sponsor. The combined value of the prizes to be awarded is $4,000.00 and the combined value of the donations to be made to Cancer Research Centers is $4,000.00.

In order to be declared a winner, the selected entrants, must, unaided, correctly answer a time-limited mathematical skill testing question, sign a Declaration and Liability Release form verifying compliance with the rules and regulations and acceptance of the prize as awarded and return all documents within ten (10) business days of receipt. Prizes must be accepted as awarded, are non-refundable and non-transferable. The Contest Sponsor reserves the right to substitute a prize of equal or greater value.

In the event a selected entrant cannot be contacted within seven (7) days of prize notification, the entrant will be disqualified and another selected entrant will be randomly chosen from the remainder of eligible entries.

In the event a selected entrant fails to correctly answer the skill-testing question, fails to return his/her Declaration and Liability Release form, or otherwise fails to comply with these official Rules and Regulations, such entrant will be disqualified and another entrant will be randomly chosen from the remaining eligible entries.

The odds of winning a prize depends on the number of eligible entries received.

PRIZE DRAWS

There will be four (4) random draws held by The Marco Corporation, 470 Hardy Road, Brantford, ON N3V 6T1 (“the Independent Judging Organization”) as follows: one (1) to be held on March 14, 2008 for all eligible entries received up to and including February 29, 2008; one (1) to be held on June 14, 2008 for all eligible entries received up to and including May 30, 2008, one (1) to be held September 14, 2008 for all eligible entries received up to and including August 29, 2008 and one (1) to be held December 14, 2008 for all eligible entries received up to and including November 28, 2008.

GENERAL

This Contest is governed by the laws of the Province of Ontario and the laws of Canada applicable therein, and is subject to all applicable federal, provincial and municipal laws and regulations. Before entering the Contest, each entrant must review and agree to be bound by the Official Contest Rules and Regulations and by entering the Contest, entrants accept and agree to be bound by the Official Contest Rules and Regulations. All decisions of the Independent Contest Judging Organization and the Contest Sponsor are final and binding in all matters relating to this promotion and the Contest Sponsor and the Independent Contest Judging Organization shall not be held responsible for any accident, negligence, printing, administrative or other errors that may arise or occur in connection with the Contest.

All entries must be received by the closing dates described above to be eligible for the specified draw. The Contest Sponsor will not be responsible for incomplete, lost, stolen, late, delayed, misdirected, illegible, damaged, altered, irregular or destroyed entries.

No correspondence will be entered into except with the selected entrants. By entering this Contest, each entrant consents, to the extent permitted by law, to the use of their name, city of residence, video image, voice, likeness, and/or photograph in any publicity, advertising carried out in any medium by the Contest Sponsor and its agencies, advertising and promotional agencies or Internet posting without further notification or compensation.

All entries become the property of the Contest Sponsor upon receipt and will not be returned. No responsibility will be taken for any failure of the website during the promotion. The Sponsor reserves the right to cancel or modify this contest if, in its sole subjective discretion, it determines that for any reason this contest is not capable of running as originally planned, or if fraud or any other occurrence compromises the fairness or integrity of this contest. Without limiting the generality of the foregoing, the Sponsor reserves the right, in its sole discretion, to cancel or suspend the Internet portion of this contest should a virus, bug or any other cause beyond the reasonable control of the Sponsor corrupt the security or proper administration of this contest.

Any attempt to deliberately damage any web site or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws, and should such an attempt be made, the Contest Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law - including criminal prosecution. Entries are subject to verification and will be declared invalid if they are illegible, mechanically reproduced, mutilated, forged, falsified, altered or tampered with in any way.

The Sponsor respects your right to privacy. By entering this contest, each entrant expressly consents to the Contest Sponsor, its promotional agencies and the Independent Contest Judging Organization, storing, and using the personal information submitted with his/her entry only for the purpose of administering the contest and in accordance with Contest Sponsor’s Privacy Policy unless the entrant otherwise agrees.
